General booking conditions

The web site 'mas-des-oliviers-vacances' offers its user, with free access on the Internet, access to the information available at the time of connection. These general and specific conditions apply to all apartments offered on the site for seasonal rental.

By contracting online, the customer declares to accept the following general conditions

The contractual information is presented in French, English and German and will be the subject of a confirmation

resuming this contractual information at the time of the online purchase procedure and by the provision of a furnished rental contract.

The owner of the site reserves the right to cancel any order from a customer with whom there is a dispute over payment or previous occupation, a doubt as to his solvency, his honesty, his identity, his right to use the proposed means of payment, the potential for behavior likely to disturb other occupants or to exercise an illegal activity in the premises, without the latter being able to claim any compensation for any reason whatsoever. The validation by the customer of his order constitutes acceptance of these general and specific conditions

fully and without reservation. The data recorded by the web site: 'mas-des-oliviers-vacances' constitutes proof of all transactions between it and its customers.

The data recorded by the payment system constitutes proof of financial transactions. Accepting cookies may be essential for any booking on 'mas-des-oliviers-vacances'.

Article-01

Purpose of the contract

This seasonal rental contract is reserved for the exclusive use of renting an apartment on the property named: "Le Mas des Oliviers", located: Route de Maureillas (D618) in 66400 Céret.

Article-02

Length of stay

The rental that is the subject of this agreement is a seasonal rental, the duration of which may not exceed 90 days.

The tenant signing this contract may not, under any circumstances, claim any right to remain on the premises at the end of the stay.

Article-03

Rates

'mas-des-oliviers-vacances' reserves the right to change its prices at any time. Stays are all billed based on the rates in effect at the time the reservation is registered. Prices are inclusive of all taxes and are expressed in Euros. They are per accommodation and per week, unless otherwise indicated. They do not include tourist tax or additional services. Our product offers and prices are valid as long as they are visible on the site.

All orders, regardless of their origin, are payable in Euros.

Article-04

Payment

The reservation becomes effective once the tenant has sent the owner a deposit of 30% of the total amount of the stay.

The rental concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, whether individuals or legal entities, unless otherwise agreed in writing by the owner.

Any breach of this last paragraph would be likely to result in the immediate termination of the rental due to the tenant's fault, with the rental proceeds remaining definitively acquired by the owner.

Article-05

Promotional offers

All our offers are not cumulative unless otherwise specified. Our site automatically takes into account all offers and the degression to ensure the best offer.

Article-06

Tourist taxes

The tourist tax is not included in the rates. Its amount is set by the municipality which has instructed 'mas-des-oliviers-vacances' to collect it from customers and pay it back to them.

Article-07

Changes to essential elements of the reservation by 'le Mas des Oliviers'

When, before the start of the rental, the customer is forced to make a change to one of the essential elements of the contract, the customer may, after having been informed:

  • either terminate his contract and obtain, without penalty, the immediate reimbursement of the sums paid;
  • or accept the modification proposed by the seller;

A written exchange specifying the modifications made may then be sent to the customer upon simple request; any price reductions are deducted from the sums possibly still owed by the customer and, if the payment already made by the latter exceeds the price of the modified service, the surplus must be returned to him before the date of his departure.

Article-08

Changes to essential elements of the reservation by the client

If the customer wishes to modify his reservation, once it has been confirmed, we will do everything possible to satisfy him.

In the event that this proves impossible, the customer may request the cancellation of the original reservation which will be subject to the cancellation conditions set out in paragraph 9.

In the event that illegal or harmful activities in terms of neighborhood (lack of hygiene, noise pollution, aggressiveness, etc.) are suspected or noted, after having carried out checks likely to remove doubts (identities, visits to the premises, viewing of video surveillance, etc.), URL of the site reserves the right to cancel the stay purely and simply.

In this specific case, no refund of the sums paid will be made by 'mas-des-oliviers-vacances'.

Any recourse must then be exercised with the owner or before the competent courts (art. 24).

In the event of physical resistance, calling the police will be considered.

Article-09

Cancellation conditions

Cancellation before arrival:

The deposit remains with the owner. The owner may request the balance of the stay if the cancellation occurs less than 30 days before the scheduled arrival date.

If the tenant does not respond within 24 hours of the arrival date indicated on the contract, this contract becomes null and void, and the owner may dispose of the rental. The deposit also remains with the owner, who will request payment of the balance of the rental.

If the stay is shortened, the rental price remains with the owner. No refunds will be issued.

Mas-des-oliviers-vacances reserves the right to cancel a reservation within 24 hours of the online booking for any reason other than those indicated in the introduction. In this case, the customer's deposit will be returned within 7 days.

For all other reservations made by letter, telephone, or online, the tenant does not benefit from the right of withdrawal, in accordance with Article L121-21-8 of the French Consumer Code, which relates in particular to accommodation services provided on a specific date or frequency.

In the event of cancellation of the stay by the owner, the owner will refund the tenant the full amount paid.

Article-10

Arrival

The tenant must arrive on the specified day and at the time of arrival mentioned on the confirmation of his reservation. In the event of late or delayed arrival, the tenant must notify the owner.

Article-11

Settlement of balance

The balance of the rental is paid upon entry to the premises.

Article-12

Departure

The tenant must vacate the apartment no later than 10:00 a.m. on the day specified in the confirmation of his reservation. In the event of late or delayed departure, the tenant must notify the owner.

Article-13

Inventory

An inventory is drawn up jointly and signed by the tenant and the owner or his representative upon arrival and departure. This inventory constitutes the only reference in the event of a dispute concerning the inventory of fixtures.

The cleanliness of the apartment upon the tenant's arrival must be noted in the inventory of fixtures. Cleaning of the premises is the responsibility of the tenant during the rental period and before departure. The amount of any cleaning costs is established on the basis of the calculation mentioned in the description sheet.

Article-14

Security deposit or surety

Upon arrival of the tenant, a security deposit of €300 is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned, less the cost of restoring the premises if damage was noted.

In the event of early departure (before the agreed departure time) preventing the establishment of the inventory on the same day of the tenant's departure, the security deposit is returned by the owner within a period not exceeding one week.

Article-15

Accommodations

All furnished accommodation presented to customers complies with French safety standards and is regularly checked. They are equipped for tourist stays. The description systematically specifies the maximum number of beds in each rental. The accommodation may not under any circumstances be occupied by a number greater than that indicated on the site.

Article-16

Use of premises

The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.

Article-17

Capacity

This contract is established for a maximum capacity of people. If the number of tenants exceeds the indicated capacity, the owner may refuse the additional guests. Any modification or termination of the contract will be considered at the client's initiative.

Article-18

Animals

Animals are not allowed on the Mas des Oliviers property. In case of non-compliance with this clause, the owner may refuse the stay: no refund will then be made.

Article-19

Insurance

The tenant is responsible for all damages caused by him. He is required to be insured by a holiday insurance contract for these various risks.

Article-20

Payment of charges

At the end of the stay, the tenant must pay the owner for charges not included in the price.

Their amount is established on the basis of calculation mentioned in this contract and in the description sheet and proof is provided by the owner.

Article-21

Complaints

Any possible complaint during the guest's stay must be reported immediately to the operations manager in order to resolve the problem as quickly as possible.

If the problem encountered cannot be resolved immediately, the guest should send a detailed written complaint as soon as possible to allow the operations manager to propose a solution.

The guest will not be able to claim any compensation in the event of urgent repairs having to be carried out during his stay inside the accommodation.

Article-22

Additional information

Internet access is possible and free via a WIFI connection present throughout the establishment and in all furnished accommodation.

Photos

The photos and plans shown are not contractual.

Article-24

Competent jurisdiction

The parties expressly attribute jurisdiction to the Courts of Perpignan.
